One of the new features of the exchange this year is participants indicating if they are open to treats. If someone has not included any statement about treats in their sign-up but have set their AO3 profile to allow anyone to gift them works, can we still give them a treat?

I don't see why not. The sign up treat statement is there to help you figure out if they set it up but you can always try anyway.
